Hi attorney,
I know the question sounds weird.
My husband applied EB2 in 2007. 140 approved and 485 pending. But then we came back to our home country because of layoff. We carried AP but now AP is expiring in 3 weeks. I know after AP goes expired, our 485 will be considered abandoned.
I heard that PD is still ours even in the case of abandonment of 485. So, I still hope that some day we can come back to US to re-do the green card application. My question is, once PD becomes current, how long will the window to submit 485 be open for us?

As far as I know Boeing, NASA, Raytheon etc. who recruit candidates from West Coast and some East Coast schools, pay great salaries to fresh graduates who are US citizens. If engineers expect to be making anything close to the bloated salaries in Finance, they are in the wrong major.
Doesn't it still mean that there's a shortage of people willing to work in Engineering and they have to import that talent?
It's like the time in school, when the only people willing to work in on-campus restaurant jobs like Subway, Wendys etc. were desis or Chinese: because the salary per hr was minimum wage and lot of American kids felt its beneath them to work there. It did create a shortage of people in that line.
I frankly don't understand the line of reasoning followed by Lou Dobbs & Co.

I don't see the gain. Although a fresh L petition has better chance of approval, you still have to get a visa approved, which may get rejected.
Given your wife's situation of EAD, you are better off applying for an extension here. They will not reject an application as long it meets all the requirements.
Thanks ! I dont know if the reasons for rejection are entirely based on merits of the petition but from experience of my coworkers around here, the employer advises a fresh petition. If I wish to go for a fresh petition how soon can I travel before my VISA expiry date ? Is there any deadline stipulated ? My VISA expires on 11/18/2008. Can I travel in Sept and submit a fresh petition for approval ?

Check the I-94 date on the previous extension. If she overstayed beyond that date it could lead to 3/10 year bar depending upon her period of overstay. USCIS rarely ever grant extension for more that 6 months after the initial six month admission.

Here are some tips that may help our last minute filers. The issue today is a degree that has not yet been awarded. In the past, the USCIS has approved H-1B petitions (http://www.h1b.biz/lawyer-attorney-1137085.html)for aliens seeking one of the 20,000 H-1B visas available to aliens who have earned master�s or higher degrees from U.S. institutions of higher education, where the alien has completed all requirements for the degree, and hence, has �earned� the degree, but the degree has not been conferred.
There is no reason to believe that USCIS will not continue that practice, so long as there is evidence that the alien has completed all requirements from an official at the educational institution qualified to provide that information. In the past, satisfactory evidence often was in the form of a letter from an official such as a Dean, Registrar, or department head, stating that all requirements have been satisfied and that the alien is simply waiting for the ceremonial conferral of the degree.
Be wary of letters prepared by unauthorized employees at the school stating that the student has completed all requirements toward a master�s degree, when in fact there are still examinations or papers to complete. USCIS is likely to question a letter that comes from a lower-level employee of the university. Be mindful also that use of such documentation when the student has not completed the program may be considered fraud. Also, use of such a document may result in the loss of the client�s chance at a slot in the U.S. master�s graduate quota since the petition likely would be denied on the basis of ineligibility at the time of filing.

Advance Parole is not a requirement to maintain status. AP is used to get back into the country based on a pending 485. If you have a valid H1/H4 and just want to stay with it and get back on H1/H4 that is totally fine. AP is optional in your case.

In my experience, that level of qualification might cut it for a community college (that gives associate degrees) or adjunct positions (very low paid temporary positions) in 4 year colleges, but won't for a full time tenure track position (requires Ph.D.). Business schools might have some flexibility in hiring if the person has a very strong business background (e.g., CEO of some company).
Anyway, most academic positions are advertised in academickeys.com and the Chronicle of Higher Education. Around bay area, other than Stanford and Berkeley, you have SJSU.

My I140 is approved and I485 is pending. I am working Full Time as a Software Devloper on EAD with a Consulting Company. I have been offered a part time work of same nature by my friend. He has a company and he offers to pay me on 1099.
Would it be ok to work part time(15 Hrs. per week) and accept payment on 1099.
Please advise.

Check recent visa bulletin. Now a days, bringing spouse by Citizen and GC holders are of not much difference. Go to India and do the marriage, and come back and file I-130. December bulletin calling for August 2010 filers. Forget about H1B and F1.

My wife have a birth certificate from the muncipality. The birth was registered soon after she was born and her parents named her before registration so there are no issues as far as late registration or "no name" is concerned. The only concern I have is that the birth certificate mentions only the first names of her and her mother although her father's full name is mentioned. Will this be a problem. The muncipalities in India register the birth in this manner, their explanation being that a child's full name is his/her first name followed by the father's full name. Similarly a married woman's full name is her first name followed by the husband's full name. I know this is not necessarily true in the USA. So I was wondering if this might be a problem.
Is there anyone in this forum who had a similar situation and their certificate worked?

Ok, you know I love your pictures, so I played with curves and masking. Since I've been on the coast many times, I know those cliffs have a lot more detail than your photo, so I wanted to bring them out. I went for subtlety and not intensity in the color version. I don't know if it looked like this or not, but this is what I imagine it to be. Layering and adjusting curves can significantly change the "feel" of the picture to more closely emulate what you saw.
Also, I really like the BW version for dramatic feel. Michael Michael Michael.... you do such nice work... there's always a jewel in the center with a bit of tweakin... that's what I love about your work! Many possibilities with one pic! :)
