What will be my status after i file my I485?
My current I-94 will expire on 16th Sep 2007 (on the day my current visa stamp in my passport expires and my current H1 B is set to expire Mid April 2008).
I am planning to make a trip to Cannda or someplace to get a new I-94 as soon as i get my new passport (i had sent it for renewal on june 2nd). But i am a little worried about my status if i am unable to make the trip.
So my question is what will be my status after 16th sep 2007 (once i file for I485 (first week of July2007) and my I-94 expires on 16th Sep 2007)?
Appreciate any responses ...
Your status has nothing to do with that. If you say that your H1B is good till April 2008, then you are in status till then

Your status has nothing to do with that. If you say that your H1B is good till April 2008, then you are in status till then

You will know what I am talking. USCIS folks are dumb a.. and sitting on AOS applications for long time. The direction is clearly coming from TOP. After July VB fiasco, they cannot sit on it as they have created landmines. They lied in the past about the processing delays for lack of resources. If they decide to stand by that lie, then they are creating landmines for themselves towards future. If they dont stand by that lie, then any small mistake will be exposed with seveal questions from outside. The only way out is to go to Pappa and ask for his signature on the solution. They have all the solutions and we dont have to tell them any.

Wasnt there some official from USCIS that said that EB2 from India with 09 priority date can expect a 5-6 year wait...

I disagree with waitingnwaiting. I had got 221G about 5 years back. I work for one of the fortune 500 company and had all the paperwork sent by our company's professional law firm. US embassy randomly picks application for processing. It took abt a month to get the approval. As long as the application/documentation is correct and there is nothing to worry.
I would suggest to spend more relaxed time with family or going out which we rarely get with 3-4 weeks vacation.

The issue is that my company lawyer said that there will be a need for a visa stamping done for the extension because of the Last action rule. The murthy forum reference is something I dug up via google.
Because the extension will be for a future date (March 1). Current visa stamp is till Feb 28, 2007. So if the officer gives a new I-94 with Feb 28, 2007 as the validity date, the attorneys claim that it will invalidate the approved extension due to a "Last Action Rule".
It is hard to trust these corporate lawyers.
I guess the USCIS letter also talks about change of status from F1 to H1 and not extension of an already valid H1 for 3 more years.

Please share your experience with us when done.
Mine is already done last month. You may have to wait there for couple of hours if you go on weekend. But once your number comes, it will be very fast.
It takes
20 minutes - 1.5 hours - Waiting time
5 minutes for physical checkup
2 minutes for shots
1 minute for blood work and PPD
2 minutes to pay initial fee
48-72 hours for PPD results ( Since labs are very very busy, they may take upto 4 days to send them blood work report)
After 48-72 hours
30-40 minutes wait to show your ppd result
1 minute - Dr to see PPD result
10 minutes - for xray if ppd positive
5 minutes - other shots if your blood report says so
5-10 minutes - for dr to read x-ray
2 minutes to pay for remaining fees
30 minutes - wait to get your sealed envelop ( otherwise go next day)

I would say Canada because British Columbia has a much higher standard of living than Boston. Canada is generally a much better place for raising kids and the stress levels are lower because of freebies like health care etc. BC also has a much better weather compared to Boston.
The other reason is that you could always come to the USA from Canada later but if you lose the Canadian PR now and don't manage to get a green card in the US, you lose everything.

Not only am I faced with a decision of staying in the US or going to Canada, but my future career is on the line too. This year I will be 23. After taking my undergrad degree in electrical engineering, I have been accepted into Boston University Law School in the US as well as the University of British Columbia Faculty of Law in Canada. Canadian lawyers make around half as much as American ones after all factors are considered.
In your opinion, should I stay in the US, going to law school, in hopes that the green card will come through, or should I pursue a new life in Canada, but take the lower future salary / international renown?
This issue is currently causing much discord in my family. I hope to hear your frank opinion so that I won't take my decision lightly.

There was life before green card. There is life after green card. And then there will be a realization afterwards that greencard is nothning but an official identification of a person that is willing to be a slave to the American System and then going to india and acting as a VIP .
Your value will always be equal to shit in this system and when you go to India what you earn here is shit compared to what you are losing by staying here.

In my opinion the USCIS and DOS will not get the August bulletin out in time. They have to figure out what to do with the July Fiasco first. They probably will delay this till they fix the July Fiasco.

Change of states is trigeering RFE. If you have moved considerable distance from your previous location the RFE will ask for an updated EVL explaining that you still have the job. Which can be easily addressed by your employer & lawyer. So dont worry and wait for 5 working days to receive the RFE.

Although I appreciate your (the core team) efforts and support them, we are still light years away from a quick and effective solution of the backlog and retrogression problems. All - government, Senate, Congress, Immigration service, big business etc do not care at all about the legal immigrants (better not use another popular expression :-). Do you need a prove for that !? And do you know why is that ? - because nobody "votes with the feet" and there is a permanent flow of "dreamers" hoping to get a GC. The big business is interested in guest workers, not in quick resolution of the GC problem - idiots like us cost less, do not dear to demand rights and are quiet and patient people who could bear a lot. And do not forget that the big business pulls the strings of the politicians.
Bottom line - the lack of negative feedback (voting with the feet for example) contributed to the current mess in the Immigration.

Is it adequate if we know the case number? I was able to dig out my case number from there.
A few question related to the database:
1) Is the received date the same as the date the labor was filed (in other words, the priority date)
2) The 2005 and after database structure does not have employee name, and there are multiple records found on "prioirty" date, is there any other field that can be verified from other documents like the case number etc? How to nail down to exact record for me?
3) Is the SOC code the same as what we should be looking for "same or similar" job?
4) Assuming answer to above Q is yes, from where can we find detailed job duties for these codes?
