    Mine took 8 days after the online status changed to approved-so don't worry. It's funny, on their website, they said documents mailed on sept 10, but i rcvd them on sept 17th. When i rcvd the AP, i realized the documents were mailed on sept 13-sept -- so don't blindly trust what is online.

    There was a black line---uscis printer completely screwed up-and the first line of the address on mailing envelope and the address was completely un-readable. I am not sure how we even got it in mail.

    I second to CC123. I had G-28 on everything. I got the EAD and AP directly. However, I did not get any original receipt notices from USCIS. My lawyer got the all original receipt notices.

    Yes, I've had this problem and I'm nearly at the end of my rope with Nikon. I've been a Nikon user for over a decade now. I own three Nikon bodies, 7 Nikkor lenses (mostly AFD primes), and two Nikon speedlights. I do mostly existing-light photojournalism as well as macro photography and landscapes.

    Originally, my D70 had horrible backfocus with anything wider than a 70mm lens. The left AF sensor in particular was completely useless. After the first repair, the camera was much improved. I bought a $1000 12-24mm Nikkor, only to find the camera didn't focus properly with the lens. I sent both lens and camera in. I got the camera back a few days ago and it is worse than when I sent it in. I don't think Nikon Service has any quality control. The problem was obvious from the first few shots I took. The left AF sensor is again useless and the center sensor is marginal. At f2.8, it is obvious that the depth of field is all behind the subject.

    I have an old N90s that takes painfully sharp pictures with the same lenses that I put on the D70. I'm going to give Nikon one more chance. If they don't fix it, I'm going to sell all my Nikon gear and never buy another thing from Nikon as long as I live. After years of shooting Velvia, I've found I really like digital photography and I'm not going to stick with Nikon if they can't provide quality products or at least proper repair.

    Congrats! I tried the same like you, so far INS didn't respond.

    Filed cased independently back in 2007 (pre & post july fiasco). In september lawyer sent
    a letter to INS with marriage certificate to adjudicate both the cases together. By september end INS promptly approved my wife's GC. When I spoke to INS over phone, they mentioned the letter is of no use, since my wife's case is approved.:confused:

    Any suggestions how to proceed. Out of job now, moving on to EAD from H1 after 10 years!

    Hi,

    I have become a PR in year 2004. Here is my experience.

    Pulled my vehicle aside well ahead of the toll gate.
    (I knew if i cross that toll that means i left USA.)
    Informed cop/securitythat i am leaving USA for good and need to resturn I-94 to CBP. He asked me to park near the Duty free store and showed me an entrance for CBP.
    CBP offcier asked the following things.
    1. Where are you going ?
    A. Landing to become canadian PR.
    2. Will you come back ?
    A. No. I will reside in Canada.
    3. Give me your passport.
    A. Gave him the passport (He looked at PR Visa)
    4. Note down this I-94 number. For some reason if you decide to come back in less than 30days, make sure you give this number to CBP here if you dont get USA visa stamped in the passport.

    Went to the canada immigration. They stamped in the passport as
    " LANDED IMMIGRANT AS OF 11/24/2004 ". Asked me to show the title of the car on my name (They verified that i dont have any loan pending on it).
    Asked about goods to follow. I told them. I am not going to bring any thing, i will buy in canada. They asked for proof of funds. I showed bank letter and some certified checks. Thats it.

    Every border has CBP. Their building will be facing to wards Canada as their main work is checking the incoming traffic. How ever its our responsibility that we reach them and submit I-94.

    Going back to his home country is the only option?

    Disclaimer - This is only based on my knowledge gathered from different forums so take it as its worth.

    Depending on the timing of your return, you will get 2 or 3 years of RNOR (Returning non ordinary resident or something?). The RNOR status makes your overseas income non-taxable in India. So you can withdraw your 401K in those 3 years and pay less or no tax in US and no tax in India (on 401K withdraw). You will still have to pay a 10% penalty. This will ofcourse only work if you have low balance in 401K.

    So for example, if you have a $30K in your 401K, you can withdraw $10K every year for 3 years, pay a $1K in penalty and avoid US taxes (due to exemption limits) as well as Indian taxes (due to RNOR status). But if you have a large 401K balance like 100K or something, there is no way to avoid taxes.

    I agree with your research on India's tax Status. But I believe for US tax purpose we wont be Resident Alien unless we pass Substantial Presence test (unless we have a GC). We will be considered as Non Resident Aliens. The standard deduction for NRA's is 3k not 10K. Above 3K we need to pay 30% flat rate tax. If you have 30K and if you withdraw 10K per year then your tax will be paying 2100$ tax and 1000$ withdrawl penalty per year. In summary your tax rate could be upto 40%.

    One other strategy is withdraw everything the leaving year and pay tax and put it in some investment like stocks, mutual funds or some savings. The gains wont be taxed in US if you are NRA (There are some exceptions like real estate stocks etc.). It won't be taxed in India due to RNOR status. So you can avoid taxes on the gain.

    Disclaimer: Above is my interpretation from NRA tax law which could be wrong.

    Maybe I am missing something here but the green card for this beneficiary was started in 2005. The PD of 2000 is due to a labor-substitution. Aren't those the facts here?

    No way nurses and EB1 would count more than 5-6k per year....

    Even out of the 30-40k like I said before about 50% would be from india and china (mostley Eb3) with later priority dates which puts them behind us

    Eb2 Filings have drasticaally gone down because of the USCIS rule

    Even after giving away all spill over visas to EB2 india and china they will have a lot of visas pending and If USCIS has made the decision that no Visa will go wasted period then we definitely have a great chance


    Again my assumption is based on the FACT that USCIS has a policy that all employment Visa numebrs must be used



    Lets keep it simple. In the next 4 years there will be 140k * 4 = 560K visas and I would say out of that the only ones with priority before Eb3 india and China are

    Eb1 ROW +india & china
    EB2 ROW
    EB2 India + china (very limited new cases)

    and I don't think the above categories would count more than 150k which should leave a lot of pending visas for Eb3

    Which would leave a lot of Visa numbers for Eb3 India/china and ROW


    Only time would tell if you are right or wrong but I like your view. Shows a ray of hope in an otherwise bleak outlook of the future.

    I think it's a way to manage your own expectations - if EBn works out in a reasonable amount of time (varies from person to person), the US is a great place to be, otherwise, your own country is not all that bad. :D

    My case is as detailed below, and my questions follow:

    PD: July 2007, EB2 (India), Software field
    Labor, I-140: Approved, I-485 etc. NOT filed.
    H1 Petition and Visa valid until: Jan 2011 (after 7th year extension)
    Currently outside US, NOT working for the H1 sponsoring employer.
    My employer has NOT revoked my H1 or I-140.
    I was working for the employer in US where the GC process started. Then moved to Canada in early 2008 when the PD was highly retrogressed/unavailable. Since then, worked in Canada in related field for a different (Canadian) employer. Things have been tough here: lower pay, very high taxes, friends all in US, and especially - the weather. We would like to return to US.

    I will soon be able to apply for Canadian citizenship. I am in a dilemma now - whether to return to US on H1 NOW or to become a Canadian citizen and try my options LATER. I have the following questions:

    (Same employer, as Indian citizen, knowing that I did not work for them for over 2 yrs, and was outside USA):
    1) can I now(or anytime until Jan 2011 visa expiry) return to US to work for the same H1 sponsoring employer on the existing H1?
    2) would I be allowed the H1 extension in Jan 2011 based on approved I-140? Or is that doomed to be rejected because I was not working for the employer in between for over 2 yrs.
    3) Would the fact that I was out of US for 2 years help me get a "regular" extension?
    4) could I continue the GC after a gap of 2 yrs while I was not working for the employer?
    5) if yes, will my PD of July 2007 be maintained?

    (Different employer, as Indian citizen, knowing that I am currently out of the US):
    6) if I get an offer from a different employer in US, could the new employer do an H1 "transfer"? i.e. would I need to wait for the April 1/October for H1 application/visa and would it be counted against the yearly H1 quota - or - can the new employer do the H1 "transfer" immediately?
    7) For the H1 "transfer", would I need to produce US paystubs for the last few months (which I cannot, since I am not in US)?
    8) if the new employer applies for my GC, could I re-use my old PD of July 2007? If yes, would the profile need to be exactly the same as the previous Labor/I-140?

    If I become a Canadian Citizen:
    9) if I become a Canadian citizen, (my H1 would have expired by then) will I be able to return to work on H1 in US for the same or a different employer as a Canadian Citizen?
    10) could I reuse my PD of July 2007 when working for the same or a different employer after changing my Citizenship? Would the job profile need to be the same?

    Also:
    11) is it possible to switch the GC processing to "future employment", although the Labor/I-140 were approved with the understanding that I was to continue working for the same employer?
    12) is the H1 visa/Priority Date of approved labor/I-140 carried over when the individual changes citizenship - from Indian to Canadian?
    13) when do the dependents' citizenship come into the picture in the GC process? If I continue to be an Indian citizen but my spouse becomes a Canadian citizen, will my approved Labor/I-140 be affected in any way?

    Please help me in getting the facts so that I can make an informed decision in this dilemma. Any help appreciated.

    I140 denied from NSC .got REF on 03/08 . Was for A2p.fellows got same RFE and got approved from same employer but mine got denied .Didnt get official notice yet .What are my options .please advise.
    Im on 4 ye H1b .and have option to change employer and also have option to keep the same employer and work for another employer at the same time .

    Keep your options open regarding changing employers and file for an appeal if you can. Notice should tell you the reason for denial. What is your employer/attorney saying?

    Im trying frantically to post this as a new thread but in vain . I would be ogliged if any1 of u can guide me through the process . Also not wasting further time i would like some info which is purely based on my discretion , but suggestion is well appreciated from u end .I would like to know wat r the things to be followed in h1 . Currently im facing issue with my h1 ie , my h1 was approved from this year lottery and it had a query which i have sent a letter to ins through my consultant , in aug but i have not recd any update so far . Im all confused as to what is my status coz at time im told that im on student visa and at time on h1 . Also if i find a job i will be paid only wen its valid . currently i stand on a crossroad of confusion , agony , pain and frustation . pls some 1 guide me thrgh this and if reqd i would apprecciate if u can also mail me .     I efiled EAD and AP for my wife and myself over this weekend. My earlier documents had been filed at TSC. In answering Question 11 of EAD, I "assumed" Dallas TX Field office and USCIS TSC are one and the same. So I selected Dallas TX Field office as the answer.

    When the receipts were generated for our applications they were generated for National Benefits Center with MSC as the prefix. This got me confused and I asked this question (http://immigrationvoice.org/forum/showthread.php?t=19323) on IV. This evening to research what is going on I started a dummy application and saw what I had done wrong. I canceled the dummy application.

    I am writing this to alert anyone to not do the same mistake. I am mighty concerned. I will call USCIS tomorrow morning and ask on what will happen and where should I send me supporting documents. I will also get hold of some local attorney.

    In the mean time what do you guys think of our situation. Any experiences, ideas? Please share. This will be long night :-|
    hi mirchiseth, I recently applied AP to wrong location. I guess some one had the same situation while back. Do you remember how did that fixed.
    Basically my case is pending at texas, but i wrongly sected missory and so my receipt number says MSC, that is what i realized that it was efiled to wrong location. Any help in this would be appreciated.
    I also took infopass appointment to check, i am not sure if i get help with out getting the confirmation receipt as i efiled yesterday.
