Why don't you ask your parents or some one who can help you to check with Registrar if they can apply on your behalf if you give power of attorney?I think this is the first thing you need to do if not yet.
If that is possible they can provide copies of your passport, marriage photos.

As a Primary Applicant my GC was approved (EB-1) but for my wife's application I got an RFE. RFE - USCIS is asking for a VALID wedding certificate showing proof of a hindu wedding under hindu act (dont ask what I was doing or what my lawyer was doing while submitting 485)
Now I have about 28 days (total is 30) to respond to it. I have not rcvd. my GC but it has been approved and has been sent to production. My lawyer told me that as my GC has been approved my VISA is not good anymore. My wife was on dependent visa and so is my kid.
Now as my GC got approved.......my visa got cancelled...........my wife's & kids visa is invalid.............and we did not file for Advance Parole so we cant travel. On top of all this we dont have a wedding certificate.
Any suggestion to address this situation? I cant get a certificate without going back to India and I cant leave the country as If I do so I wont get to enter the country again. Even if somehow (on some legal basis) I can re enter I dont think my wife and kid will be able to re enter US.
If I dont produce evidence then my wife's application will be rejected putting her out of status.............gosh what a mess.....

For one thing - there would be thousands of applications between 07/19 and 07/28 (mine being one of those :D) and the other is that the USCIS doesnt pre-adjudicate. Since the PD has only moved recently, the processing dates didnt move that rapidly
Yes, There will be thousand of applications, but not all of them will have their PD before June 2006. And that's why processing dates will move forward rapidly. In August 15th report this will be evident.

it was a proud moment for me and my wife to attend the rally. I really felt that we are trying to make some differance. hats off to aman kapoor and whole core team who are putting their heart and soul even though they have green card already. salute to core team.....but as aman and logiclife said this is just beginning, real work starts now,we have to educate the people in power about differance in legan and illegal immigration. so people lets start spreading the message to the people whom we know and who are not active.

July 23rd filer. NSC>CSC>NSC. Did not get FP notice and will be travelling to India this friday for 2 months. So called up Customer service and opened SR for both me and wife on December 20. Got appointment for me for Jan. 16th but nothing for my wife in the first week of Jan. Then a week ago got a second set of appointments both for me and wife but now on Jan. 18th.
Anyways, reported to USCIS office in Des Moines today (Jan. 16th) per original letter. Wife accompanied me and I had all the appointment letters with me. Explained to the security guy (a very nice old gentleman) about the situation with upcoming travel, etc. He went and soke with the USCIS manager and she was gracious enough to allow my wife to get her fps done with me. Was out of the place in about an hour. They had a new machine installed and the person from the machine manufacturer was demonstrating how to use to the local staff, so we were all guinea pigs. Scanned four fingers from left hand followed by thumb, then four fingers from right hand followed by thumb, this was followed by each finger individually rolled across the scanner, then took FP of right index finger and asked me to sign (similar to a credit card digital sign box). Took a photo and that was it.
One piece of interest to people who for some reason missed theit appointments and forgot to reschedule. I was informed by the security guy that there is a grace period of 87 business days after your initial appointment date for you to walk-in and get your fps done. However, you need to call the center to find out what day of the week is alloted for walk-ins. (It is Wednesday for Des Moines office).
If you have multiple appointments for different days (like I had), go to the earliest one if possible and get both the notices stamped with the stamp indicating that biometrics were taken on that date.

I applied for H1B extension in October 2006 as my H1B was about to expire in December. After five months of applying, got an RFE in February 2007 . My employer replied to the query in Mid March 2007. My employer was reluctant to do a premium processing when he replied the query, saying that he doesn't want to take any risk. CSC transfered my case to Seattle, WA field office ( the field office is no where near my employers physical location, not even close to where I live) on April 4th. I guessed that its because of new H1 petitions filed in April. Its been more than 3 months and no action taken on my petition. We tried to convert into premium processing, but the field office rejected it saying they don't accept premium processing in their jurisdiction. So nothing else to do but to wait wait wait. Total time passed since my initial petition in October ( 9 months).
My license has expired in March and the DMV do not renew my license with out a new I-94. Really its been a hell with out DL and still depending on others for necessary needs.
I am tired of telling the story to every one. Why not one more time here. I want to find out what other steps I can take to expedite the H1 Petition. Is there any way around to get the license renewed. Please share your experiences and suggestions.

Guys please post some ideas on how to deal with this situation. I even opened a service request about my case. But no progress. what should be my next course of action to move the case.

We have 8000+ members but only 200+ contributed. I have been thinking about it and here is one possible answer. If you look at the poll result about whether we should push for 485 or not, there are about 280 guys supporting this goal. Maybe almost all recurring contributions are from this group. :confused:

I'm not sure about H1 after using AP. Make sure with others.
Yup, I had checked this because even I thought entering on AP invalidates H-1B, but he said that's not the case. In fact, my company still renews H-1B for my colleagues who have used AP to reenter.
Has anyone heard otherwise from a lawyer?

Ron is a very decent guy, he is not my attorney but he has helped me with really good advice that helped me a lot.
Once I posted a question during the weekend and asked him a very specific question (My attorney was out of town) and he not only gave me the right answer but also posted detail information about the actual law behind it. Beleive me I needed the answer that weekend.
Every law firm wants clients but most of the lawyers would charge you $200 or $300 for 1/2 session, I know this becasue I have done this as well.
Ron answers your questions on his forum with out any charges, anybody can see this if they go to his site.

I have a similar question. I have I-94 till Jan 2008 as my H1B visa is valid till Jan 2008. If I file an H1B extension in Dec, is that okay ? I know, approval would not come before Jan 08.

I need your help in this scenario. I went to India during Mar 06 and got a stamping on my passport till Jun 2010 (based on my I140 approval). But at the POE, the officer stamped my I-94 till Jun 07 as he could only stamp the date that was on my current I-797. He also told me that I can goto the local USCIS office and extend my I-94 till 2010. Is it true? and if so, how would I go about doing that??
