Is PD porting allowed without ever working for the future employer who got I-140 approved? Is this still possible if the future employer revokes the I-140 because employee does not intend to join them?

Thanks for the info Morchu. I've just been concerned with the recent emails where USCIS seems to be ignoring the successor-in-interest clause. Also, I'll have to contact my attorney to see if re-filing of I-140 is required. It took 1 year for the first one - just frustrating to think how long it will take if the re-filing is required. I guess I don't have to worry about the retrogression for the 485 stage anytime soon!

My PERM was filed and I got the following email from my lawyers
" Labor Certification by ABC ABC, Inc. on your behalf has been submitted via the Department of Labors (DOL) Permanent Online System as of the above date (April 1) . The application will be adjudicated by a National PERM Processing Center. As the DOL does not currently have a processing schedule for PERM applications, we are unable to predict how long processing will take. In the past, PERM applications have been adjudicated anywhere from a few weeks to several months. Unfortunately, there is currently no way for beneficiaries to check the status of the application. We will contact you as soon as we hear anything specific regarding your case. "
1. Is there any place where you can check the status ? Since I do not have any reference number, and from the text of the email, I doubt that.
2. I checked some forums and found that the average processing time is 60 days. Which processing center should I be looking for ? (I work at Oracle in SFO)

Hi,
I am currently on my first OPT which expires in June second week. The company which I am working for is an everified company, hence I applied for my STEM extension last week(I did not get the receipt of confirmation/the new OPT STEM extension card till now). As the STEM extension rules say that we can work for a maximum of 180 days without getting out OPT card, I thought its fine and hence applied a little late.
The problem here is that my company is getting acquired by another company(this company is not e-verified, but they are planning to get everified, don't know when). It is still in the process of acquisition and the deal is expected to close by July. As this company is not everified(as of now) I cannot work for this company after my first opt expires, till it gets the everified status. As is a general phenomena that when a bigger company acquires another company, some cost cutting might happen.
I have a few questions.
1) Do you guys suggest applying for a H1B, with my current company (The problem is that even if my current company applies H1B, I cannot work for the new company as my H1 will be in processing and the new company is not everified, and I would be out of status. I cannot face this situation if the new company gets everified status before my first opt expires, but I am not sure if this is going to happen).
2)If I file my H1b and the new company decides to not take anyone from the previous company, then my opt would have been canceled as I have applied for H1, and I would not also get H1.
3)If I get my H1 approved before we get removed, I would have only 1 month(grace period between H1 jobs, I assume) to get a new job and transfer my H1.
4)Also I dont know if I apply for H1 during the time of acquisition, I am kinda confused what happens with the processing.
I am really sorry if there is a similar post, but I could not find any. Also I could jolt down only the above scenarios. Please help if there are any other scenarios I missed out.
Kindly Advice.
Thanks in advance.

I do have house here and I am 6th year of H1B, I did appeal on my I-140. If that gets denied I have no option than going back. In that case I have to sell my house or file bankruptcy foreclosure +++.

Is more than 6 yrs of IT experience from a non-computers engg background good for applying for EB2 position? Can you comment from your experience.
I have similar situation. I am getting an already approved labor for gc processing. it needs 5yrs progressive exp and bachelor degree in engg. Now I do have nearly 5 years at the time of application and now (9 years). have same degree work for same company as the company applied and also match in experience almost 100%. Is there any risk in I140 approval.

PROJECT MANAGERS:
-Min 5 years of Functional and Technical experience.
-Exp with Microsoft .Net OR JAVA Technology
-Bachelors or Masters Degree is preffered.
The above ad sent out by my company is very confusing to me. Please some one help me understand the ad.
I have MS + 2.3 yrs of experience. 2.3 yrs is gained as Programmer analyst/software developer
your ideas are helpful
Every year of education = 2 years of work experience. In your case it should be:
Masters with 2 years of relevant work experience OR
Bachelors with 6 years of relevant work experience. Atleast thats what I remember from my EB2 PERM application.

I played around with this a bit, and found the solution. The problem occurred when I had "Empty Project." I created a new project "Console Application," and then I was able to "load" the Process class/namespace. Can anyone explain to me why this would happen? I did a few searches online, but didn't find much help...
Those who have been using C# for a while, what type of project do you mostly choose that are NOT GUI?
Thanks! :)

Hi ,
My H1 expires next week and I am having my FP date 11/13.My company HR recommends that I don't need to go for the 8th year extension. They say that it is a kind of money and time waste to go for extensions. They say that it is good to work on EAD.But my question is what happens if there is a pro with I485?What do you guys recommend????
Can you guys tell me the forms that have to be filled for H4 Extensions.I want to save the $$$that I have to pay for the attorney.
Thanks

I understand that a H1B visa is the expense to the employer and is not a taxable benefit to the employee. If a company wishes to pay for the green card for the employee, granting them permanent residence in the U.S., is this a taxable benefit to the employee? Should it be added to their W-2? If yes, where is the IRS documentation on this? I cant find it. Thanks.
