Do I still need a copy of I-140 if I have I-797 extended for 3 years from the existing employer?

If you already have your h1 extended for 3 years then you can get those 3 years with employer 2. Consult a lawyer though, when you actually switch jobs.

No.3 and 4 are my favorites.....but No. 4 is the one I wud choose as best. I like the touch of green and the sky is superb. Horizon Line is straight on. The pic is sharp all around, but what really catches me when I first viewed the picture is the "bolt" in the fence.
I agree, and also agree with FNM's comments about why #1 and #2 don't work for me.

My 485 was filed on july 2nd, have'nt recieved the RN,Now i want to file for EAD/AP without RN (cos need it badly for my wife) but the lawyer is advicing against it. He says...

My concern in filing the EAD/AP applications without the I-485 Receipt Notice is that it will take USCIS a long time to marry the files together, and that much longer to adjudicate, versus filing the EAD/AP applications with the I-485 Receipt Notice. In the latter case, the application can stand on its own, in that USCIS does not have to "search" for any other file; in this instance, we suspect USCIS will adjudicate these applications faster.

Anyone in the same boat..

I feel your lawyer is definitely correct. If you send I485, EAD and AP forms together, you don't need to worry about A#. Whereas if you file I485 only and then apply EAD and AP later, you definitely need A#(which you can find in I485 receipt notice) to fill in the EAD and AP forms. What # would you give in these forms for A#?

But again this is my personal thought.

I am starting this thread to track I-485 applications that did not receive receipt notices yet after filing in July-August

I filed on August 15th
No receipt notice yet as of Nov, 5, 2007

Anybody else in similar situation ?

Hi,
Quick question here. Suppose the h1 receipt was not attached and the application was already sent by july2. Can we send in a copy of H1 extension receipt now ?
My h1b visa expired in april 2007 and extension was filed in feb 2007. I94 also expired in april 2007. I am thinking as long as u apply aos application within 180 days of being out of status for any reason we are in status.
Correct me if im wrong and add any info that you may feel is relevant..

That is right. If it is feasible go for it. Also, what do you mean by residency for ur wife..medical one ?

In either case she can always come here for interviews on a B2 visitor, I know people who have done/doing it for medical residency.

I am in the same situation. My case reached NSC on July 2nd. But received receipt from CSC with WAC#. After that received EAD. Yesterday received mail stating that my case is transferred to NSC for jurisdiction with RD Aug. 28t and ND Sep. 6th.

My I140 got approved few months back before I485 applied date.

Congrats and great job. However, I disagree with the salary part you
mentioned in your interview. You had mentioned that the salary used to
be 1/10 or even 1/20 of the US salary when you moved back to India. Do you
think this is correct ? I dont think that is a correct ratio

At times, unconsciously, we exagerate how bad it is in India while it is not.

Last week, I submitted my documents to my lawyer but until now I haven't received any confirmation from my employer yet if my application has been filed already. We are not allowed to contact our lawyer directly so I'm just relying on my employer about this. I'm quite concerned coz there's no way for me to find out if they have filed it or not.
Is there a way? Please help me please. Thank you

The AOS (485) is based on the I-140 approved for the beneficiary listed in the I-140 and not the labor. Besides, the DOL is not really concerned about EB2 or EB3 category. The DOL asks for the alien information just to verify that the job ad is not tailored to meet the alien's qualifications. EB2, EB3, etc are categories under the INA which become applicable only once the I0140 is filed. In a nutshell, your friend should have consulted another attorney before the I-140 was filed under EB3. It is not possible to change the 485 filing to EB2 based on the labor because the immediately preceding step to filing 485 is the I-140 which governs.

So you mean after appeal they can approve my I140?

I do not know my PD. But my labor was filed sometime in Dec 2006.

I had this issue with my labor not with I140. My employer provided all the required documents and then it was approved. As long as your company is financialy sound . you should get approved.

BTW, when did you file your I-140?

Immigration Voice would like to request members of its community stuck in the green card process that are scientists, researchers, professors and working in the area of national importance. Basically anything that will benefit this country in any way (economically, health related, sciences etc)

We would like make a strong case via media through such interviews and if we are successful in getting such interviews published, these media interviews would be used when presentations are made to lawmakers.

I have recently spent 2 weeks in Chennai and my overall taxi experience has been very good being non Tamil speaking. All Taxis charge more when the starting point is Airport. That is inevitable. If it is just to drop them at the nearest hotel, ask them to approach the Govt Prepaid Taxi booth.

Govt's is cheaper compared to the private Taxis. Ofcourse the Govt only has Ambassadors as the Taxis. Do not expect the Taxis to be neat and clean like here. Expect broken handles.....There are 3 other private Taxi booths, of the private taxis Fasttrack seemed a little lesser compared to others, almost all private taxi rates are closer.

If they need the Taxi from hotel check out Fasttrack website and get teh phone no for Chennai. They have been pretty good an picking me on time, but make sure you reserve it well in advance (4-5 hrs). Whenever I called in the last minute, they were not on time.

I did stay at a hotel far from Airport - clsoer to work. So might not be useful to u.

My experience with Taxis at Chennai airport have always been bad. They quote you a rate at the taxi counter and when you go to board the car, they will add on other charges saying that there is a lot of luggage. Anything more than two large suitcases, they charge at least 150 to 200. You have to haggle with them to not pay. Even the people at the counters side with the Taxi drivers.

Of late, I am having a call taxi service come to the airport to pick me up. You can talk to the hotel people to arrange for the taxi. it comes close to the actual fare quoted initially, but you wont have to pay those exhorbitant charges for luggage.
