    Hi,

    I have an California EB2 RIR LC app pending with backlog center with PD of March 2005. My 6 years of H1B are over and am an Indian citizen.
    Is it a good idea to convert this application to PERM - my company lawyers say that there is a risk in that if the application is rejected, there is no back-up + it can take upto 8 months to process under PERM due to the conversion.

    It is very true that it might take a long time for the conversion cases to get approved. Mine took 6 months with audit. Your PERM application must be identical (not similar, it should be 100% identical) to your RIR case. They will take months to pull your RIR out from the BEC and compare it with the new PERM and if 100% identical they will approve. It is possible. It can be done. I got mine done. It will take time. It is risky especially when your 6 year limit is over. There are ways to stay in status even if it gets rejected. But are you willing to take the risk?

    Alright buddy, The only loan I've is few hundred dollars on my credit card which I pay every month though! Car is paid and no home! Sorry, no money from me to you! You have to find another person! I can buy you a cup of coffee though so that you can relax a bit!
    But I do respect if any non GC holder go and buy a home.
    I agree with your point about defaulters. But take your argument elsewhere.
    In California, a musician who claimed 100K income/year was asked to stand in front of his home with his musical instrument and photographed. That photograph went into Washington Mutual's file as income proof. If you think, the housing crisis is because of defaulters, you are partially wrong! Prices went very high and people couldnt buy and that is the reason home prices went down. Since it went down, loans backed up by those very assets lost value. And people defaulted because what they owe was higher than the value of home!
    You are really delusional if you think non GC home-owners are to be blamed for this mess!

    You really need a good tax refund from the government! File your taxes soon!
    His gripe is not about non-gc holder buying house, but the general mentality of abandoning commitment that homeowners signed and that someone else has to clean up their mess.

    Cam somebody please explain what ETF's are with a simple example; web definitions on it are too technical for me. Thanks

    etf is very much like a pool of money that is used to buy certain set of stocks and then that set of stocks itself is divided into many equally priced units and sold to you, me and who ever wants to buy. after the "units" are sold, there are no new contributions to the pool of money and the stock composition does not change (in most cases). the exception is that in some cases, when the etf's "set of stocks" is actually a representation of an index (e.g. the SPY etf tracks s&p500), if the index itself changes (so if s&p 500 gets a new stock in it and an old stock is removed) then the etf holdings may change. to do all this crap, the company that puts together the initial pool of money charges a management fee.

    the closes relative of an etf is the closed ended mutual fund. the only difference is that there is active management of the fund throughout it's life to maximize returns (i.e. stocks are bought and sold). typically, to do this crap, companies (understandably) charge more management fee.

    in investor's terms, if you want direct but diversified exposure to a specific sector or specific index or specific anything of the market, then ETFs are a great instrument!

    I am not sure on address.. For Child - I dont think you can add the name to your passport unless you plan not to have a separate passport for the child..

    Thanks for the info. I am planning to add my wife name by providing marriage certificate. Can i add my child name with his birth certificate. By not providing other address , can i avoid having US address on my passport.

    Don’t blame non-contributing members too much. They are also frustrated with the retrogression and wish for a relief. $20/mon is not a big deal for most high skilled professionals. But what if someone didn’t get the message? What if someone doesn’t have a paypal account? There should be some other ways for people to pledge the money and make sure it will be used wisely. I guess the right strategy is how to reach more people with the correct information. Honestly speaking, I don’t know how many of 8400 really got this message.

    If there are 200 online users and IV already got 128 contributing members, the percentage looks pretty amazing to me. There will be more, of course, when they get to know this and come to the website, read and understand that they have a chance and also a responsibility to help themselves by doing this.

    I am starting this thread for people to share some nice sweet memories about the rally.

    This Part 1 is basically for "WHO MET WHO"

    Most of us in these forums - we talked on phones for a long time and discussed a lot of topics - and we met each other in real at the rally.

    I was excited - and I want to share some of my experiences.

    Please post some experiences on this thread like mine below

    I drove from New York with 5 other dedicated IV members ie tnite, tikka, siraviny, ps57002 and a new member Arun

    At the Rally I met Niloufer(needhelp) and Vandana, drona and other volunteers at the registration desk and was nice to meet you all.

    Then came paskal and gsc999 who stuck a badge on my shirt "chanduv23" and then I met Shivakanth, Vijay Anand and other folks.

    After that I met Macaca - lovable guy, some core members like indio0617, ashish, tamsen.

    Then I met pappu. As soon as I greeted him he stood up. I thought he was respecting me. I felt honored. But after a while - he was standing up to anyone who greets him. Then I figured out that was his habit - and no respect or whatever :D:D:D

    Then met Abhijeet who was carrying his guiter and then jazzbythebay, janilsal and other folks and Jay and Aman and all core team members

    Then I met all the Chinese friends in the NY chapter, Jane, Sophia and it was nice knowing them

    I did miss out a few names - but overall I loved this experience of meeting you all the folks

    Pappu and me stopped at Union Stn for lunch on the way back after the rally. We were both physically drained and famished. Our jaws dropped when we spotted a desi restaurant there. You all should have seen how we attacked the food !

    Well that would be an option make H1b portable.
    But then most consulting companies will not hire H1B's because it won't be cost effective.
    Anyway just by checking most of this consulting firms businesses they will be able to uncover all the fraud.
    It's very unethical to make you lie on your resume and then try to market you to an employer with fake experience, also nobody has responded to my comment. Real Companies like PWC, IBM pay you while you're on bench, while this indian consulting companies break the law by not doing that.

    Hmm, being an Ex-IBM Employee and for the record, let me tell you something. As long as one can charge his or her time to a billable project, no one cares. Otherwise, all you get is a grace period of 2 paychecks to prove the worth of employment. I'm telling you this truth with a verifiable employment history of more than 8 years in USA.
    My friend, all that matters is how much revenue one can generate. Just doesn't matter whether you are working for Big5 or small and tiny consulting companies.

    Guys let it be selfishness... but ultimately if we win, it is a win for every one... I am living in this country for more than 11 years but still with an EAD status.... We are spending most of our life time as an ALIEN. Think yourself which is better...

    Saralayar, I agree to your point. As a note, you have to understand I have been in this country for about 13 years and working in the same job since 1999. I am still waiting for my green card as you can see from my priority date.

    I don't mind members enthusiastically starting a campaign. I am all for it. I am sure IV core is also in support of it. But we also need to identify people who really believe in the cause and will continue with the cause irrespective of what happens to their situation. In this case, GCPerm has shown that the cause what he/she fights for depends on which basket he/she wants to pick his fruits from. When he/she gets his/her share of fruits they will leave.

    I hope we do not waste our time and resources with people who are bound to leave when their situation is clear. That is my point.

    I do not see GCPerm as a leader who will continue to resolve misery of people suffering due to backlog even after he/she gets his/her citizenship. Wasting time and money with that kind of a leader will lead nowhere.

    I have created a letter template (linked below), I have a couple questions that I have put in the comments so you guys can provide some input.

    I am going to create another template that you can use to fill in your name and other related information (naidu2543 brought up a good point and I am somewhat skeptical on adding the case number. Admins, any input?). I think we should all have hand-written signature (not typed) in that letter.

    I am going to provide a fax number and email address, where each one of you can send the signed sheet.

    I think there should be a benchmark for the signature, before we can send it out. From the polls, I see 69 people said that they would support the initiative, I think its reasonable to expect at least 65 people will send their signatures, before we can send the letter out.

    FYI we never us the terms like EB2 or EB3 in our meetings with lawmakers.

    Pappu, don't mean to argue with you. This could be one reason why DOS/USCIS spilling over all the Visa's to EB2. I do not know how to phrase it. USCIS took U-Turn on spill over after IV started pushing. I know your (IV) intention of benefiting the entire community. But every effort resulted in EB2 getting all the help. Otherwise how DOS/USCIS does not consider 2001 EB3 for spill overs? If it was law enacted as part of AC21 in 2000, why USCIS delayed implementing it till 2007?

    EB3I's. We are around 60000 (60K). If you really want to make an impact, at least 1/4 of this 60K which is 15 K should pay just $100 (one hundred) to IV for lobbying which will will total $1.5 Million. But every one should pay. believe me, some thing can be done in Lame duck session with this kind of money. Otherwise, keep renewing EAD (340.00 per person) and AP (another 340.00) every year. Or pay just hundred dollars by all the 15000 EB3I's that are waiting.

    I personally do NOT think that giving DV numbers to EB will make any difference to EB3, because once EB2 is cleared up there wil be more EB2 people out there to consume visas and there will be no spillover.

    Having said that if this bill goes through then it will most certainly give GC to EB2 people even those who have a priority date of 2011 and also to people in India who are planning to come to USA in thee next few years or so and who know enough of US immigration to know that they have to file for GC in EB2 category

    I will not even raise the point about providing a part of the 50 k visas specifically to EB3I because lets face it EB2 are the elite and deserve to have priority in visa allocation.

    Facts: As of 2007 there are 54,850 application pending in EB3 india category and as of 2007 there are 13,150 application pending in EB2 india category
